Terms of Service
The rules for our collaboration - short, fair, no fine print.

These terms apply to all assignments carried out by Tieman IT (sole proprietorship based in Borne, Netherlands; CoC number available on request). By accepting a quote you agree to these terms.
1. Definitions
- Tieman IT / 'I' / 'me': the provider, Tieman IT, sole proprietorship based in Borne
- Client / 'you': the natural or legal person entering into an agreement with Tieman IT
- Services: designing, building, hosting and maintaining websites
- Website: the digital product built and/or hosted by Tieman IT
- Monthly subscription: the recurring service for managed hosting, support, backups and included changes
2. Services
I build custom Next.js websites and provide managed hosting on them. The scope of each project is fixed in the quote: page count, modules, scope. During the project I keep you informed with intermediate steps and request feedback at set moments. Extra work outside scope is billed at an hourly rate (€95/hr excl. VAT), only after your approval.
3. Pricing and Payment
- All quoted prices are in euros and exclude 21% VAT unless otherwise stated
- Setup fee (one-time): 50% on quote approval, 50% on delivery
- Monthly subscriptions are billed in advance per calendar month
- Payment term: 14 days from invoice date
- Annual payment up front: 10% off the monthly rate
- Extra-work hourly rate: €95 excl. VAT, billed in 15-minute blocks
- Hour-card: 10 hours at €875 excl. VAT, valid 12 months
- On late payment after one reminder I may temporarily suspend the service until the invoice is paid
4. Intellectual Property
Your website's source code is yours after full payment. On request you get an export: Git repository, database dump and uploads. My own tooling (tit-ctl, TIT Platform infrastructure, brand-guide assets) remains my property. Content you provide (text, photos, logo, brand style) remains yours and is not used for other clients.
5. Liability
- I am not liable for indirect damage, consequential damage, lost profit or missed savings
- My liability is in all cases limited to the amount you paid to Tieman IT in the 3 months preceding the event, with an absolute maximum of €5,000
- I aim for 99.9% uptime per calendar month; downtime due to maintenance, force majeure or external causes (VPS provider, DNS, provider network) falls outside this target
- For damage from data breaches demonstrably caused by my negligence I am insured up to a fixed amount - details on request
6. Cancellation & Migration
- Monthly subscriptions have a minimum period of 12 months from delivery
- After the minimum period you can cancel monthly with one month's notice
- Cancellation by email to info@tieman.it is sufficient
- On cancellation you get a free full export: Git repo, database backup, uploads
- Migration to another host is billed hourly (€95/hr) - typically 4-8 hours depending on scope
- 30 days after cancellation I take the old instance permanently offline; backups are retained for another 90 days
- On my breach (e.g. absence >30 days) you get pro-rata refund of the paid subscription
7. Data Processing (GDPR)
Where I process personal data of your customers as part of the service, I do so only under your instructions and in compliance with GDPR. On request we sign a data processing agreement. Data stays on servers within the EU (Hetzner DE/FI). See also my privacy policy.
8. Force Majeure
Force majeure means circumstances beyond my reasonable control: outage of external providers (VPS, DNS, internet), long-term illness, natural disasters, fire, war. On force majeure I may suspend performance without liability for damage. I inform you as soon as possible and discuss alternatives.
9. Disputes
Dutch law applies to this agreement. We first try to solve disputes informally - an email and a conversation usually works. If we can't, the court of Overijssel (Almelo location) has jurisdiction.
10. Contact & Changes
Questions about these terms: info@tieman.it. I may unilaterally change these terms for new clients. For existing clients the terms as per quote approval apply; changes unfavourable to you are communicated at least 30 days in advance.
